Local Law 55 Compliance Experts

Local Law 55 of 2018 went into effect on January 19th, 2019. This law required landlords to use New York State licensed mold assessors (inspectors) and NYS licensed mold remediators to correct all HPD 550 mold violations.

This law was created to help prevent and resolve indoor asthma and allergen hazards in residences in NYC. The landlords of all residences in NYC are required to investigate and remove all health hazards, such as mold, and pests, inside the dwellings. Mold has been found to be a cause of health issues in NYC residences. Landlords are required to remove the mold hazards and then continue to ensure that their properties are safe from indoor health hazards.

The NYC Department of Housing Preservation and Development (HPD) and the Department of Health and Mental Hygiene (DOH) lists the requirements tenants and landlords need to do to ensure health and safety in NYC dwellings.

Landlords must:

  • Inspect every apartment and the common areas throughout the building for pest infestations and mold at least every year
  • Use integrated pest management (IPM) practices to control pests and fix building-related pest issues
  • Safely remove indoor mold and prevent it
  • Clean and inspect vacant apartments for pests and mold
  • Provide a copy of a fact sheet and a notice in each tenant’s lease that lists the tenants responsibilities to help keep the building free of allergens

Tenants should:

  • Keep apartments clean, dry and free of clutter
  • Place food in sealed containers
  • Use garbage cans with fitted lids
  • Take out garbage and recycling everyday
  • Avoid using cleaning products with strong smells
  • Inform landlords of pests, water leaks or any holes or cracks in the apartment
  • Allow maintenance workers into the apartment to make any needed repairs
  • Call 311 if landlords do not fix the problem or if repair work is being done unsafely
